SECOND.- PURPOSE OF THE WEBSITE
AL ANDALUS TOURS makes available to the public, hereinafter the "user", who accesses the WEBSITE, information about its tourism services, as well as the ability to book and pay directly for such services through the channels enabled for that purpose, hereinafter "CONTENT" and "SERVICES". The WEBSITE therefore has both an informational and a transactional nature.
The terms, conditions and procedure applicable to the electronic contracting of tourism services are regulated in the General Terms and Conditions of Contract, which form an integral part of this Legal Notice for all purposes.
AL ANDALUS TOURS may modify the content of this Legal Notice at any time. The applicable version will be the one in force at the time of access, with the date of the last update always indicated at the top of the document.
THIRD.- PROPER USE OF THE SERVICES
The user agrees to use the Services diligently, correctly and lawfully. In particular, and by way of example and not limitation, the following is prohibited:
- Using the Services for purposes or effects contrary to the law, morality, generally accepted good customs, or public order.
- Reproducing, copying, distributing, publicly communicating, transforming or modifying the Services or their content, except with the authorization of the holder of the corresponding rights or when legally permitted.
- Infringing any intellectual or industrial property rights of AL ANDALUS TOURS or third parties.
- Using the information obtained through the WEBSITE to send advertising, direct sales communications or unsolicited messages directed to a plurality of persons, as well as marketing or disclosing such information.
Third-party links and content: the WEBSITE may include links to third-party platforms, including customer review management platforms such as Google Business Profile and Trustpilot. AL ANDALUS TOURS does not control or assume responsibility for the conditions, policies or content of such platforms, which are governed by their respective terms and conditions, without prejudice to AL ANDALUS TOURS' efforts to maintain reasonable consistency between the information published on those channels and this WEBSITE.
The user shall be liable for any damages that AL ANDALUS TOURS may suffer as a result of the breach of the above obligations or of any others set out in this document or in applicable regulations.
Minors must use the WEBSITE under the supervision and with the consent of their father, mother or legal guardian, who will be responsible for the purchases and uses made through their intermediation. The processing of any personal data collected is governed by the Privacy Policy.
AL ANDALUS TOURS shall ensure compliance with applicable law and may, at its sole discretion and in a proportionate manner, suspend the Service or exclude the user from the WEBSITE in the event of reasonable indications of the commission of crimes or offenses defined in the Criminal Code, or of conduct contrary to these conditions that disrupts the operation, image or prestige of AL ANDALUS TOURS.
FOURTH.- RULES OF CONDUCT FOR CUSTOMER SERVICE
Users may contact AL ANDALUS TOURS through its customer service, available by phone every day of the week from 8:30 a.m. to 8:00 p.m., and by email on a permanent basis —24 hours, with no guaranteed response time—, provided they comply with the following code of conduct:
- No user may impersonate another person or organization. Identity theft may constitute an offense or crime under Spanish Criminal and Civil Law.
- Disrespectful or offensive language may not be used. Messages containing threats, serious insults or comments that may be degrading are not acceptable. AL ANDALUS TOURS reserves the right to remove such content and to take the legal actions that may correspond.
- Use of the customer service channel to present, cite or recommend third-party companies or websites, or to carry out marketing actions or send unsolicited communications —"spam"— is prohibited. AL ANDALUS TOURS may remove such content and the accounts responsible, without prejudice to reporting the facts to the relevant authorities, including, where applicable, the Spanish Data Protection Agency, when the conduct may constitute a breach of regulations on unsolicited commercial communications.
Personal data provided through this channel will be processed in accordance with the Privacy Policy.
FIFTH.- ELECTRONIC CONTRACT WITH THE CUSTOMER
Everything related to electronic contracting between the customer and AL ANDALUS TOURS, including the purchase procedure, prices, payment method, the right of withdrawal and its exceptions applicable to tourism services, cancellations and other contractual conditions, is regulated in the General Terms and Conditions of Contract of this WEBSITE, a document that the user must read and accept prior to contracting.
SIXTH.- APPLICABLE LAW AND JURISDICTION
These conditions are governed by Spanish law. For the resolution of any dispute that may arise in relation to this Legal Notice, the parties submit to the Courts and Tribunals of Granada, Spain, without prejudice to any mandatory jurisdiction that, in accordance with applicable regulations, may correspond to the consumer based on their domicile, and without prejudice to mandatory consumer protection provisions applicable in their country of residence when this is outside Spain.
For consumers residing in the European Union, Regulation (EU) 1215/2012 shall apply, where applicable, which may grant jurisdiction to the courts of the consumer's domicile.
